By accessing or using the Weatmood API service ("Service") operated by Weatmood ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service constitutes your acceptance of these Terms.

2. Service Description

Weatmood provides an AI-powered API service that enables developers to integrate advanced artificial intelligence models into their applications. The Service acts as an intermediary layer, routing requests to upstream AI model providers.

• Access to AI model endpoints for chat completions and text generation
• API key management and rate limiting
• Technical support and documentation

3. Service Availability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted uptime, specific latency benchmarks, or error-free operation. Performance depends on the availability and responsiveness of our upstream AI model providers. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

4. Account Registration and API Keys

To access the Service, you must register for an account and obtain an API key. You are solely responsible for maintaining the confidentiality of your API key and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your API key. We reserve the right to revoke or suspend your API key at our sole discretion.

5. Acceptable Use

You agree not to use the Service for any prohibited activities, including but not limited to:

• Any illegal, fraudulent, or unlawful purpose
• Generation of malware, viruses, or any code of a destructive nature
• Actions that violate the content policies or safety guidelines of the underlying AI model providers
• Mass unsolicited communications (spam)
• Harassment, abuse, or hate speech
• Content that infringes on intellectual property rights of third parties
• Automated mass scraping or bulk data extraction
• Use in critical infrastructure, life-safety systems, or medical devices without prior written consent

6. Rate Limits and Fair Use

We reserve the right to apply rate limits, usage quotas, or temporarily suspend access to protect the Service infrastructure from abuse, excessive concurrency, or unusual traffic patterns. We may update rate limits at any time with reasonable notice.

7. Pricing and Payment

Access to certain features or increased usage quotas may be subject to fees as communicated at the time of purchase or on our website. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with 30 days' prior notice.

8. Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by Weatmood and is protected by intellectual property laws. You retain ownership of any content you submit through the API. We do not claim any ownership rights over content generated by AI models in response to your requests. Upstream AI model providers retain their respective intellectual property rights over their models.

9. Data and Privacy

We do not permanently store, log, or archive user prompts, completions, or personal data transmitted through our API endpoints beyond what is necessary for operational purposes (e.g., transient request processing). We do not use your data to train or fine-tune AI models. Please refer to our Privacy Policy for detailed information about data handling practices.

10. Third-Party Services and Providers

The Service relies on third-party AI model providers to deliver its functionality. We do not control, endorse, or guarantee the availability, accuracy, or reliability of any third-party services. Any transactions or interactions with third-party providers are solely between you and the respective provider.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEATMOOD AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Weatmood and its owner, officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your use of the Service.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Russian Federation.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Continued use of the Service after any changes constitutes acceptance of the new Terms.
